Terms of service
Terms of Service
Overview
This website is operated by The Moon Apothecary. Throughout these Terms, “we”, “us” and “our” refer to The Moon Apothecary.
These Terms of Service govern your access to and use of our website, Ritual Library, products, content and related services. Our store is hosted by Shopify, which provides the ecommerce platform that enables us to offer our products and services to you.
By accessing our website, creating an account or placing an order, you agree to these Terms, together with our Privacy Policy, Shipping Policy, Return and Refund Policy and Care and Safety Information.
Nothing in these Terms excludes, restricts or modifies any consumer guarantee, right or remedy that cannot lawfully be excluded under the Australian Consumer Law.
1. Eligibility and accounts
You must be at least 18 years old, or have the involvement and permission of a parent or legal guardian, to make a purchase through this website.
You are responsible for ensuring that the information supplied when creating an account or placing an order is current, complete and accurate.
If you create an account, you are responsible for protecting your login credentials and for activity conducted through your account. Please contact us if you believe your account has been accessed without permission.
2. Products and product information
We make reasonable efforts to present our products, colours, crystals, botanicals, packaging and other contents accurately.
Because our products contain natural materials:
- Crystals may vary naturally in size, colour, markings, shape and appearance.
- Botanicals may vary in colour, texture, fragrance and appearance between batches.
- Product colours may appear differently depending on your screen and device settings.
- Packaging or individual components may occasionally be substituted with an item of comparable purpose and value where necessary. Any material substitution affecting the nature of the product will be disclosed where reasonably possible.
Natural variation is part of the character of these products and is not necessarily a fault. This does not limit your rights where a product is faulty, unsafe, materially different from its description or otherwise fails to meet a consumer guarantee.
Product descriptions, availability and inclusions may be updated from time to time.
3. Ritual, spiritual and wellbeing information
The Moon Apothecary’s products, rituals, affirmations, prompts and educational materials are offered as tools for personal reflection, spiritual practice, intention-setting and general wellbeing.
Individual experiences and outcomes will vary. We do not promise or guarantee specific spiritual, emotional, financial, professional, relationship, manifestation or other personal outcomes.
Our products and content are not substitutes for medical, psychological, therapeutic, financial, legal or other qualified professional advice, diagnosis or treatment.
If you are experiencing physical or mental health concerns, financial hardship or another issue requiring professional support, please seek advice from an appropriately qualified professional.
4. Care and safety
You are responsible for reading and following all instructions, ingredient information and safety guidance supplied with your product and within our Care and Safety Information.
Unless a product is expressly identified as suitable for consumption:
- Botanicals, salts, crystals and ritual contents are for external ritual use only.
- Do not consume or brew the contents.
- Keep products away from children and animals.
- Avoid contact with eyes and other sensitive areas.
- Do not use an ingredient if you have a known or suspected allergy or sensitivity to it.
- Discontinue use if irritation or an adverse reaction occurs.
Candles and other flame-based tools must never be left burning unattended and must be kept away from botanicals, fabric, paper, children, animals and flammable materials. Always use a stable, heat-resistant surface.
Crystals and other small components may present a choking hazard. Children must be supervised by a responsible adult.
Nothing in this section excludes any rights relating to product safety or consumer guarantees under Australian law.
5. Orders
Placing an order constitutes an offer to purchase the selected products.
We may decline or cancel an order where:
- A product is unavailable.
- Payment cannot be authorised.
- Customer or delivery information is incomplete or appears incorrect.
- We reasonably suspect fraud, unauthorised activity or commercial resale.
- A genuine pricing, inventory or website error has occurred.
- We are legally unable to supply the order.
If we cancel an order after payment has been received, we will notify you and refund the affected amount to the original payment method.
Please review your order carefully before submitting it. Cancellation requests will be considered where possible but may not be accommodated once preparation or dispatch has begun.
Returns, remedies and refunds are governed by our Return and Refund Policy and the Australian Consumer Law.
6. Prices and payment
All prices displayed on our Australian store are in Australian dollars unless otherwise stated.
Shipping charges are calculated and displayed at checkout. Any applicable taxes will be handled as displayed during checkout and in accordance with Australian requirements.
Prices, promotions and product availability may change without notice. A price change will not affect an order already accepted, except where a genuine and obvious pricing error has occurred.
You confirm that you are authorised to use the payment method supplied for an order. Payments may be processed by Shopify and other third-party payment providers under their respective terms and privacy practices.
7. Shipping and delivery
Orders are processed and delivered in accordance with our Shipping Policy.
Delivery dates provided by us or a carrier are estimates unless expressly stated otherwise. We will assist with delayed, missing, damaged or incorrectly delivered orders as described in our Shipping Policy and as required by Australian law.
Please provide accurate and complete delivery information. Additional costs resulting from an incorrect or incomplete address supplied by the customer may be charged where permitted by law.
8. Returns, refunds and consumer guarantees
Our Return and Refund Policy explains how we manage change-of-mind requests, cancellations, damaged products, faulty products and refunds.
We do not offer returns or refunds for ordinary changes of mind. However, our products come with guarantees that cannot be excluded under the Australian Consumer Law.
Depending on the circumstances, you may be entitled to a repair, replacement, refund or another remedy where a product is faulty, unsafe, materially different from its description or otherwise fails to meet a consumer guarantee.
9. Intellectual property
Unless otherwise stated, the website and its original content are owned by or licensed to The Moon Apothecary. This includes our:
- Moon Pouch concepts and written product content
- The Moon Weaver’s Scrolls and Herbariums
- Meet Your Moon Pouch cards
- Ritual Library content
- Ritual instructions, prompts and affirmations
- Photography, graphics, branding and website copy
- Downloadable and printed materials
Purchasing a product grants you a limited right to use its accompanying materials for your own personal, non-commercial spiritual practice.
You must not reproduce, scan, copy, republish, distribute, sell, commercially exploit, upload or share our protected materials with others without prior written permission.
This does not prevent you from sharing ordinary photographs of your personal Moon Pouch, discussing your experience or tagging The Moon Apothecary on social media.
10. Customer content, reviews and feedback
If you submit a product review or voluntarily tag or send content to The Moon Apothecary, you confirm that the content is yours or that you have permission to share it.
We will seek permission before using identifiable customer photographs, videos or personal stories in our promotional content unless the content was submitted through a feature that clearly explained how it would be used.
Reviews must reflect genuine experiences and must not contain unlawful, abusive, misleading or infringing material.
11. Acceptable website use
You must not use our website or services to:
- Break any applicable law.
- Interfere with the website’s operation or security.
- Introduce malicious code.
- Attempt unauthorised access to accounts or systems.
- Collect another person’s information without authority.
- Impersonate another person or provide deliberately false information.
- Copy or commercially exploit protected content.
- Engage in fraudulent, abusive or harmful conduct.
We may restrict access where we reasonably believe these Terms have been violated or our website, business or customers may be placed at risk.
12. Third-party services and links
Our website may contain links to or integrations with third-party services, including Shopify, payment providers, social media platforms and delivery providers.
These third parties operate under their own terms and privacy practices. We are not responsible for independent third-party websites or services outside our control.
Nothing in this section limits any responsibility The Moon Apothecary has for your order under Australian law.
13. Shopify
Our store is hosted by Shopify, which provides the ecommerce platform used to operate the website.
Purchases made through this store are transactions between you and The Moon Apothecary. Shopify is not the seller of The Moon Apothecary products.
Shopify may process information required to operate the store, facilitate checkout and provide ecommerce functionality, as described in our Privacy Policy and Shopify’s own privacy documentation.
14. Website availability and accuracy
We aim to keep our website accurate, secure and available. However, the website may occasionally be interrupted for maintenance, technical issues or circumstances beyond our reasonable control.
We may correct genuine errors, inaccuracies or omissions relating to product information, pricing, availability, promotions or shipping. If a correction materially affects an accepted order, we will contact you and provide an appropriate option, which may include cancellation and a refund.
15. Liability
To the extent permitted by law, The Moon Apothecary is not liable for loss caused by:
- Use of a product contrary to supplied instructions or safety guidance.
- Misuse, alteration or improper storage of a product.
- Reliance on spiritual or general wellbeing content as a substitute for professional advice.
- Events outside our reasonable control.
Where liability cannot legally be excluded, our liability will be limited only to the extent permitted by law.
Nothing in these Terms excludes, restricts or modifies rights, remedies or consumer guarantees available under the Australian Consumer Law or any other law that cannot lawfully be excluded.
16. Privacy
We handle personal information in accordance with our Privacy Policy.
Because our store is hosted by Shopify, personal information may also be collected and processed by Shopify and relevant service providers to operate the website, process payments, fulfil orders and provide store functionality.
17. Changes to these Terms
We may update these Terms to reflect changes to our products, services, business practices or legal obligations.
The current version will be published on this page. Changes will apply from the date they are published and will not retrospectively remove rights attached to an order already accepted.
18. Severability
If any part of these Terms is found to be unlawful, invalid or unenforceable, that part will be limited or removed only to the extent necessary. The remaining provisions will continue to apply.
19. Governing law
These Terms are governed by the laws of Queensland, Australia, and applicable Commonwealth laws.
You and The Moon Apothecary submit to the jurisdiction of the courts and tribunals of Queensland and Australia, subject to any rights you have to bring a claim in another jurisdiction under applicable consumer law.
